But neither, Madison argued, can states that are too large.

He believed that, at last, the constitution of government for which philosophers had been searching and humanity sighing since time immemorial could be realized. Finally, free and popular government could be rescued from the contempt it had so long incited and be recommended to the esteem and adoption of America, and, indeed, of all mankind. 18 The Mind of James Madison Madison’s response to the challenges presented by both ancient and modern political philosophy entailed a detailed and complex consideration of a variety of factors that conspire to shape public decisions; these include the size of the territory, its situation vis-à-vis foreign dangers, the stage of society, the moral views and cultural institutions of the nation, representation, separation of powers, checks and balances, federalism, the influence of the literati on public opinion, and the influence of public opinion on the carriers of public morality and ultimately on government.

In all governments, public opinion is a force to be reckoned with; in popular governments, public opinion constitutes the sovereign power and is the authority behind public judgments. 29 Accordingly, there was little that was effectually done to thwart the power of a factious majority, although there were attempts to restrain popular demagogues in the assembly through various checks, such as age requirements, character examinations, banishment, and even death.
